1. ACCEPTANCE OF TERMS

Welcome to ReVive ("App," "we," "our," or "us"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ReVive regarding your access to and use of the ReVive mobile application and related services.

By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

2. DESCRIPTION OF SERVICE

ReVive is an AI-powered mobile application that allows users to:

- Upload photographs of interior spaces from camera or photo library

- Select from various interior design styles

- Generate AI-powered room redesigns using OpenAI technology via AIProxy

- Save redesigned images to device photo library

- Share redesigned images

- Access premium features through subscription (managed by RevenueCat)

- Rate and provide feedback on the app experience

3. ELIGIBILITY

3.1 Age Requirements

- You must be at least 13 years old to use this App

- Users between 13-17 years old must have parental consent

- Users under 13 are prohibited from using the App

3.2 Legal Capacity

You represent that you have the legal capacity to enter into these Terms and comply with all applicable laws.

3.3 Subscription Model

- The App operates on a freemium model with limited free usage (1 free redesign)

- Additional features require a premium subscription managed through RevenueCat

- Free users are tracked locally to enforce usage limits

4. USER ACCOUNTS AND REGISTRATION

4.1 Account Creation

- No account registration is required to use basic App features

- Premium subscriptions are managed through RevenueCat and Apple's payment systems

- You are responsible for maintaining the security of your device and App data

4.2 Accurate Information

- You agree to provide accurate and complete information when using the App

- You are responsible for updating any information as necessary

5. ACCEPTABLE USE

5.1 Permitted Uses

You may use the App to:

- Upload your own photographs of interior spaces

- Generate room redesigns for personal use

- Save redesigns to your device

- Share redesigns in accordance with these Terms

5.2 Prohibited Uses

You may NOT use the App to:

- Upload images you don't own or lack permission to use

- Upload inappropriate, offensive, or illegal content

- Upload images containing people without their consent

- Violate any applicable laws or regulations

- Attempt to reverse engineer or hack the App

- Use the App for commercial purposes without written permission

- Upload copyrighted images without proper authorization

- Interfere with or disrupt the App's functionality

- Use automated systems to access the App

- Impersonate others or provide false information

6. INTELLECTUAL PROPERTY RIGHTS

6.1 App Ownership

- ReVive owns all rights to the App, including software, design, and trademarks

- These Terms do not grant you ownership of the App or its content

6.2 User Content

- You retain ownership of original photos you upload

- You grant us a limited license to process your images for redesign generation

- Redesigned images are generated using AI and may incorporate our proprietary technology

6.3 AI-Generated Content

- Redesigned images are created using artificial intelligence

- The output is generated based on your input and our AI algorithms

- You may use AI-generated redesigns for personal purposes

7. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

8. THIRD-PARTY SERVICES

8.1 OpenAI and AIProxy Integration

- Our App uses OpenAI's API services via AIProxy for AI-powered redesign functionality

- Your use of these services is subject to OpenAI's and AIProxy's terms and policies

- We are not responsible for these third-party services or any issues arising from their use

8.2 RevenueCat Integration

- Our App uses RevenueCat for subscription and payment processing

- Premium subscriptions are managed through RevenueCat's platform

- Your subscription data is subject to RevenueCat's terms and privacy policy

8.3 Apple App Store

- Your download and use of the App through the Apple App Store is subject to Apple's Terms of Service

- Apple is not responsible for the App or any claims related to it

9. DISCLAIMERS AND LIMITATIONS

9.1 Service Availability

- We strive to maintain App availability but cannot guarantee uninterrupted service

- We may modify, suspend, or discontinue the App at any time

- We are not liable for any service interruptions or modifications

9.2 AI-Generated Content Accuracy

- AI-generated redesigns are for inspiration and entertainment purposes

- Results may not accurately represent real-world design possibilities

- We make no warranties about the accuracy or feasibility of generated designs

9.3 No Professional Advice

- The App does not provide professional interior design or architectural advice

- Generated designs should not be used as the sole basis for actual renovation decisions

- Consult qualified professionals for actual renovation projects

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

10.1 We provide the App "AS IS" without warranties of any kind

10.2 We are not liable for any indirect, incidental, special, or consequential damages

10.3 Our total liability shall not exceed the amount you paid for the App (if any)

10.4 We are not responsible for any damages to your device or loss of data

11. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:

- Your use of the App

- Your violation of these Terms

- Your violation of any third-party rights

- Content you upload or share through the App

12. TERMINATION

12.1 Termination by You

- You may stop using the App at any time by deleting it from your device

12.2 Termination by Us

We may terminate or suspend your access to the App if you:

- Violate these Terms

- Engage in prohibited activities

- Cause harm to other users or our services

12.3 Effect of Termination

- Upon termination, your right to use the App ceases immediately

- We may delete any data associated with your use of the App

13. CHANGES TO TERMS

13.1 We reserve the right to modify these Terms at any time

13.2 Changes will be effective when posted in the App

13.3 Your continued use of the App constitutes acceptance of modified Terms

13.4 We will notify users of significant changes when possible

14. GOVERNING LAW AND DISPUTES

17. APPLE APP STORE SPECIFIC TERMS

If you downloaded the App from the Apple App Store, the following additional terms apply:

17.1 Apple is not a party to these Terms and has no responsibility for the App

17.2 Apple has no obligation to provide maintenance or support for the App

17.3 Apple is not responsible for any product warranty claims

17.4 Apple is not responsible for addressing any claims relating to the App

17.5 In case of any third-party claim that the App infringes intellectual property rights, we (not Apple) are responsible for the investigation and resolution

17.6 You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country

17.7 You must comply with applicable third-party terms when using the App

18. UPDATES AND MODIFICATIONS

18.1 We may provide updates to improve functionality, security, or compliance

18.2 Some updates may be required for continued use of the App

18.3 Updates may change features or functionality

18.4 Continued use after updates constitutes acceptance of changes
